 Post subject: Best BAR for 11.5" barrel?

I'm going to be SBRing my current Spikes upper by replacing the barrel with an 11.5" one (after trust, tax stamps, etc). The current upper has a 12" BAR. I plan on getting a suppressor in the future as well, so I would like to stick with the BAR. However, with the 11.5" barrel I think it's going to be too short for that rail.

Have any of you had experience with this set up?

I have the 9" rails on my 11.5" uppers. If you want to keep the 12" rail, and are just going to do a barrel swap, I would suggest looking into a 12.5" barrel if it won't be full time suppressed. Putting your support hand at the end of a 12" rail over an 11.5" barrel might not be a fun day if it has just a short muzzle device on it. You could pull it off with something like a Levang on the end.

Oh, absolutely. I wasn't clear in my last post. I want to stick with a BAR (not necessarily the current 12").

As you know, it comes in a 9 and a 10 so I was asking more about which is used more often with that barrel length.

I have a form 1 question.

If i want to get get a 10 in barrel with a 12 in BAR, should I include the length of the rail or just to where the barrel ends?

this gun will have a can attached full time.

The ATF required length is from the rear of the stock (extended, not collapsed -- I know, it's ass backwards), to the muzzle of the barrel (only a device that is attached in a fashion that makes it unable to be removed without destruction can be counted in the length). Whether the rail is longer than the barrel is irrelevant to the ATF.

just one more quick question. sorry this is my first nfa item since setting up the trust.

do i need to mail in a copy of the trust with the form 1 and the check?

is there anything else i need?

Yes, a full copy of your trust, with inventory (Schedule A), must be included with your Form 1 filing.

I'm sorry I'm so hopeless but that brings up another question. My brother, also apart of the trust, has several silencers that he has paperwork pending at the ATF. Should those be included or since he doesn't have stamps or possession, they should be left off?

You have multiple trustees within a family trust? Does your trust also multiple grantors? Only the grantors can file for stamps, and only trustees can use the property of the trust.

So if only one of you is the grantor, then only they can file for the stamps. Make sense?

As for what should be on your Schedule A... only include items that you've already received the stamps for and that the grantor has taken possession of. So if the stamp is approved, but you haven't picked up from the dealer, then you don't include. Make sense?

yeah i understand what you are saying except for our trust doesn't have any verbage about being a grantor.

we are all trustees and we are all settlors.


we used sean cody who is talked about in other threads about being a nfa trust lawyer in tx

Settlor would be the equivalent of grantor. Anything ending in "or" is your controller/owner and anything ending in "ee" is your beneficiary or user.

Trusts vary from state to state, and are non-transferable, because the power of entity creation falls under states rights, not federal. So if someone ever says their trust is 50-state legal, they are lying. The best you can do with your trust is to declare an article that allows for amendments to the original declarations. This will allow your to contact a lawyer in your new state prior to your move to update your trust for your new homes compliance. This will require a notary and witnesses to the amendments from within the new state before you transport NFA items.

As long as you are all settlors and trustees within the same trust, then you can all purchase, register, and share the benefits of common ownership within the same. And when it comes to your Schedule A, that is the same everywhere - you only add what you have taken full delivery of.
